The mining company faulted for a cave-in that killed six miners in 2007 says it has no position on a worker’s compensation claim filed by the family of one of the victims.
Genwal Resources Inc., a subsidiary of Ohio-based Murray Energy Corp., is listed in papers at the Utah Labor Commission as objecting to the claim filed by the family of coal miner Juan Carlos Payan.
But company representatives say Rockwood Casualty Insurance Co. is contesting the claim and that Murray Energy can’t order the insurer to settle the claim.
The parents of coal miner Juan Carlos Payan say he was their sole provider, and they want full benefits of about $2,400 a month for six years –a total of $172,800.
That’s five times the amount offered by Rockwood Casualty, which argues the parents in Mexico got support from other children working in the United States
