Investigators from the California Department of Insurance Criminal Investigations Branch on Tuesday arrested Jeffrey Ferguson of Tuolumne County, Calif. on charges of workers’ compensation fraud.
Ferguson is being held Tuolumne County Jail on $10,000 bail. According to CDI, Ferguson was employed as a licensed vocational nurse at Tuolumne County Hospital from August 1994 through April 1995.
During that time, Ferguson submitted four workers’ compensation claims for injuries to his wrists, back and right heel. However, CDI’s investigation found that in June 1998, Ferguson attended the 49th Tuolumne Lumber Jubilee, where he was videotaped competing in a 43-minute tug-of-war contest.
Investigators contend the videotape shows Ferguson taking part in physical activities that were contrary to his subjective claims. CDI estimated that Tuolumne County, which is self-insured, incurred losses of more than $75,000 based on Ferguson’s claims.
If convicted, Ferguson could face up to five years in state prison and/or a fine of up to $50,000. The case is being prosecuted by the Tuolumne County District Attorney’s Office.
