The federal jury in New York, which is deliberating over the terms of the binding agreements governing the recovery for the destruction of the World Trade Center (See previous articles) has ended the sixth day without reaching a verdict.
Judge Michael Mukasey indicated that one juror “wanted out” of the deliberations. According to later reports the juror had decided to remain on the case for the present. If the jury were less than complete, it would present the parties with the possibility that a unanimous decision could not be reached.
Judge Mukasey asked both sides – Silverstein Properties, Swiss Re and the other insurers – if they would accept this. While neither side rejected the possibility – which could result in a mistrial – neither side immediately accepted it either. Both sides indicated they needed time to study the situation.
The jury is scheduled to continue its deliberations on Thursday, after an off-day today.
