The South Dakota Supreme Court has upheld a circuit judge’s decision to grant a new trial in a medical malpractice lawsuit against a Huron doctor.
The lawsuit arose out of complications suffered by Lillian Glanzer after she had gall bladder surgery in 2001. A jury last year found that Dr. Richard Reed was not negligent.
But Circuit Judge Jon Erickson later granted Glanzer’s motion for a new trial because the Supreme Court had issued a new decision on jury instructions to be used in medical malpractice cases.
